This agreement must be signed IN ADDITION TO THE STANDARD CLIENT AGREEMENT. This agreement made between the studio Boston Photography LLC and the client is for Underwater Portrait Experiences designed and photographed by Boston Photography LLC at the studio location pool or another offsite location. Underwater Portrait Art Experience Fee is required prior to the session. Portraits from this session must be ordered in 11x14 sizes or larger or as a duplicate to one that is that size. Pricing and Product options are discussed and provided to the client.

1. COMPENSATION

In order to secure your session, 50% of the Experience Fee/Session Fee is required upon booking. The remaining balance is due the day of the session. It is understood that all portraits purchased from the Underwater Session must be at least in an 11x14 of any media offered at the studio. Duplications of those can be ordered smaller.

2. CANCELLATION

Please understand a lot of preparation goes into an Underwater Session, i.e. pool quality preparation takes several days, equipment preparation, etc.. If you need to cancel or postpone the session, you are required to provide a 3 day (72 hour) notice. Without this notice, the deposit will not be refundable and the studio is not responsible for rescheduling. If the photographer needs to cancel the session, notification will be provided as soon as possible and a refund can be provided.

3. GENERAL LIABILITY

The Studio shall not be liable for omissions caused by failure of the Client to maintain all agreed schedules or caused by delays due to inaccurate information provided by the Client. The Studio shall not be liable for failures or faults in the manufacture or processing of materials or other causes that may reasonably be deemed beyond the control of the Studio. In the event such circumstances prevent the Studio from performing its obligations or delivering the agreed product or service, the Client’s sole remedy shall be the refund of any deposits, as a Limitation on Damages. Omissions or failure to produce specific images that may be discussed or proposed at a planning session shall not void this agreement and/or shall not result in compensation to the Client by the Studio.tion

4. PERSONAL LIABILITY

It is understood that the water temperature may feel cold but will be above 74 degrees and the client is entering into the water and temperatures at their own risks. Clients must be good swimmers and responsible for themselves in the pool or waterbody. Underwater photography is dangerous. It is understood that the client’s ability underwater is the client’s responsibility. The client may be photographed underwater where breath holding is typical, but the client at anytime can come up for air, stop the session and is responsible for monitoring their own health. The photographer can also stop the session if they deem the client looks distressed, cold, or if other health concerns are assumed. Even with expert swimmers, death can occur underwater. The Photographer or Studio is not liable for any injury, medical incidents, or death that occur from the session.
